PROTECTION OF CHILDREN

Publisher - Current Law Journal

The ‘Protection of Children’ comprises 25 Chapters and lays out the principles and cases regarding children. Laws for the protection of children are the first safety net for the survival, protection and healthy development of children. The Malaysian government plays a major role in supporting families. It has made significant progress in the care and development of young children. A large number of policies and programmes are already in place to ensure the well-being of children and their families, with particular attention to health care and education. Along with the rights of children during court procedures and maintenance thereafter, the Author has researched and discussed cases that are unique to Malaysia. Chapters include the effects of the conversion of religion on children and the difficult issues of child trafficking in the country. Cases and decisions from the Family Courts of Singapore, the United Kingdom, Canada and Australia are also reviewed. It is hoped that this will shade some information as to how Family Courts in these jurisdictions operate, in order that we may enhance our own family court system. After the World Summit for Children in 1990, ‘Caring for Children of Malaysia - A National Plan of Action for Child Survival, Protection and Development’ was drawn up. Children and young people have to have a voice in what we do and how we do it, especially where a policy or service may have a direct impact on them. Children and young people need to be heard. There is a need for us to promote, communicate and deliver our commitments to listening to children. Courts have to ensure that children and young people have a voice in legal proceedings concerning their future, whether these proceedings arise from family breakdown, care, adoption, or criminal proceedings. Children’s innocence and vulnerability exposes them to exploitation, sexual abuse and domestic violence. When couples argue, the likelihood of transferring the anger and hitting out at children is high as well. The abuse and ill-treatment of children calls for special, focused attention because for the most part, children cannot speak for themselves. The Book will be a very useful source of reference for legal and medical practitioners, law students, care-givers, parents, the police and anyone who is interested in safe-guarding the interest of children.
